Tenho escrito muitos prefácios para livros, mas nenhum me deu tanto prazer em tempos recentes quanto o livro de Caetano Costa. Estou a falar de quê? De um livro de teoria jurídica, de um livro de sociologia do direito, de um romance que tem como principais personagens dois juízes? Estou a falar de tudo isso e nessa complexidade reside o fascínio desta obra, cuja leitura eu recomendo vivamente a todos e a todas.

In this article we explore the argument against the interruption of pregnancy – as defined above – in order to show 1) the impossibility of establishing a neutral point of view regarding knowledge; 2) the existence of a psychological motivation which justifies the longing for an absolute criterion for the evaluation of human actions. O artigo examina a descriçáo e a crítica nietzscheanas do método dialético socrático, bem como o método de investigaçáo nietzscheano – a genealogia. Nietzsche considera o ser humano um criador de conceitos e de métodos de investigaçáo. Os métodos de investigaçáo, por sua vez, sáo associados a tipos humanos e a suas formas de relacionamento com a realidade efetiva. A genealogia analisa a vontade de potência que produz os conceitos e a considera como sintoma de um tipo humano. Dworkin respondeu afirmativamente à pergunta título do seu texto “Não existe mesmo nenhuma resposta certa em casos controversos?”. Posner criticou Dworkin e respondeu a mesma pergunta negativamente. Discute-se neste artigo as diferentes maneiras como cada filósofo entendeu a pergunta que acarreta diferentes respostas a ela, isto é, de que modo diferenças na concepção do que é o Direito acarretam diferenças a respeito da existência de respostas certas para questões jurídicas.

The present article wishes to examine John Caputo’s notion of ‘hyperbolic justice’ considering his critique of Heideggerian philosophy. In Demythologizing Heidegger (1993), Caputo tries to deconstruct Martin Heidegger’s account of Dasein’s being as Sorge, as Being-towards-death in its existentiality, facticity and fallenness, not by rejecting that account but by showing that it is fissured by an absence, the absence of kardia (heart), of flesh, disablement, affliction. According to Caputo, Heidegger’s aesthetics of Being, and his concern to overcome the oblivion of (...) Being, left him scandalously oblivious to the cry of the suffering other. Against Heidegger, Caputo opposes what he calls the “prophetic imagination” of Emmanuel Levinas, Jean-François Lyotard, and particularly Jacques Derrida. I will seek to examine the ways in which Caputo opposes to Heidegger Derrida’s ‘undeconstructibility of justice,’ whilst also resorting to Levinas’ ‘hyperbolic justice’. (shrink)

The main objective of this work is to discuss the materiality of relationships and experiences of infants in early childhood education, based on a dialogue with the Brazilian curriculum guidelines for Early Childhood Education in 3 municipalities in the state of São Paulo, and with the concepts of technical objects and individuation developed by Simondon. This is a qualitative research that uses bibliographic and documentary research as a methodology and the production of cartographies of scenes in which relationships between babies (...) and objects are observed. The cartography used here is inspired by the records developed by Fernand Deligny (2015) and its appropriation for research with babies, as proposed by Julia Oliveira (2016). Research was carried out on this topic in the field of education, going through scientific articles and guiding documents for early childhood education. The authors mapped the paths and affections of babies and their relationships with objects in two distinct scenes that were collected within the scope of a collective project. It is a work that contributes to early childhood education in general and, specifically, to baby studies (Infantology, Babyhood studies). (shrink)

Inaugurado na Grécia antiga, o método axiomático passou por grandes mudanças ao longo da história. Este artigo busca estabelecer as fases de evolução da abordagem axiomática. En este artículo se analizan, desde la antropología social, representaciones del orden social manifestadas por el fenómeno de las mandas y exvotos en el culto a santo Domingo Vidal, santo popular patrono del municipio de Chimá (Colombia). La metodología incluyó la observación participante en el sitio del culto y la descripción del Libro de mandas en el que escriben los devotos; los escritos son vistos como textos que transmiten y reproducen formas de cultura y de organización social. Para el análisis (...) se acude a los conceptos de Religión como sistema cultural y de Religión común para enfatizar su carácter adaptativo a las circunstancias locales. Las primeras conclusiones sugieren que la relación de los devotos con el santo responde a las condiciones sociales particulares de la comunidad en la que ocurre el culto y que esas prácticas las reproducen y mantienen. The Unified Foundational Ontology (UFO) was developed over the last two decades by consistently putting together theories from areas such as formal ontology in philosophy, cognitive science, linguistics, and philosophical logics. It comprises a number of micro-theories addressing fundamental conceptual modeling notions, including entity types and relationship types. The aim of this paper is to summarize the current state of UFO, presenting a formalization of the ontology, along with the analysis of a number of cases to illustrate the application of (...) UFO and facilitate its comparison with other foundational ontologies in this special issue. For over a decade now, a community of researchers has contributed to the development of the Unified Foundational Ontology (UFO) - aimed at providing foundations for all major conceptual modeling constructs. This ontology has led to the development of an Ontology-Driven Conceptual Modeling language dubbed OntoUML, reflecting the ontological micro-theories comprising UFO. Over the years, UFO and OntoUML have been successfully employed in a number of academic, industrial and governmental settings to create conceptual models in a variety of different domains. (...) These experiences have pointed out to opportunities of improvement not only to the language itself but also to its underlying theory. In this paper, we take the first step in that direction by revising the theory of types in UFO in response to empirical evidence. The new version of this theory shows that many of the meta-types present in OntoUML (differentiating Kinds, Roles, Phases, Mixins, etc.) should be considered not as restricted to Substantial types but instead should be applied to model Endurant Types in general, including Relator types, Quality types and Mode types. We also contribute a formal characterization of this fragment of the theory, which is then used to advance a metamodel for OntoUML 2.0. Finally, we propose a computational support tool implementing this updated metamodel. (shrink)

The paper provides a new and detailed critique of Barker and Dowe’s argument against multi-location. This critique is not only novel but also less committal than previous ones in the literature in that it does not require hefty metaphysical assumptions. The paper also provides an analysis of some metaphysical relations between mereological and locational principles.

Os registros históricos humanos sofreram transformações à medida em que evoluíam as tecnologias. Quanto maior a evolução tecnológica, mais informações puderam ser disseminadas. O objetivo desta pesquisa é discutir as possíveis similaridades entre a Ciência da Informação e as nuances pós-modernas. Como procedimentos metodológicos apresenta uma pesquisa de natureza qualitativa e exploratória baseada em uma revisão bibliográfica. O estudo possibilitou a confirmação dos elementos relacionais para uma compreensão dialógica entre a pós-modernidade, a complexidade e a Ciência da Informação. O pensamento (...) pós-moderno questiona paradigmas consolidados na Ciência Moderna, contrapondo-se às ideias e práticas inerentes ao pensamento científico baseado no paradigma dominante, mais especificamente nos preceitos provenientes do racionalismo científico, da visão reducionista e da discrepante realidade de grupos sociais. This paper is an attempt to solve the following problem: given a logic, how to turn it into a paraconsistent one? In other words, given a logic in which ex falso quodlibet holds, how to convert it into a logic not satisfying this principle? We use a framework provided by category theory in order to define a category of consequence structures. Then, we propose a functor to transform a logic not able to deal with contradictions into a paraconsistent one. Some strategies to turn any logic into a paraconsistent system are examined. In the environment of universal logic, we show how to paraconsistentize logics at the abstract level using a transformation in the class of all abstract logics called paraconsistentization by consistent sets. Moreover, by means of the notions of paradeduction and paraconsequence we go on applying the process of changing a logic converting it into a paraconsistent system. We also examine how this transformation can be performed using multideductive abstract (...) logics. To conclude, the conceptual notion paraconsistent orbit of a logic is proposed. (shrink)

This article introduces some concepts that help exploring the ontological import of universal logic. It studies the notions of an antilogic and counterlogic associated to each logic and shows some of their properties. It presents the notion of galaxy, as the class of possible worlds compatible with a given logic.We explore some consequences of these developments.

Types are fundamental for conceptual modeling and knowledge representation, being an essential construct in all major modeling languages in these fields. Despite that, from an ontological and cognitive point of view, there has been a lack of theoretical support for precisely defining a consensual view on types. As a consequence, there has been a lack of precise methodological support for users when choosing the best way to model general terms representing types that appear in a domain, and for building sound (...) taxonomic structures involving them. For over a decade now, a community of researchers has contributed to the development of the Unified Foundational Ontology (UFO) - aimed at providing foundations for all major conceptual modeling constructs. At the core of this enterprise, there has been a theory of types specially designed to address these issues. This theory is ontologically well- founded, psychologically informed, and formally characterized. These results have led to the development of a Conceptual Modelling language dubbed OntoUML, reflecting the ontological micro-theories comprising UFO. Over the years, UFO and OntoUML have been successfully employed on conceptual model design in a variety of domains including academic, industrial, and governmental settings. These experiences exposed improvement opportunities for both the OntoUML language and its underlying theory, UFO. In this paper, we revise the theory of types in UFO in response to empirical evidence. The new version of this theory shows that many of OntoUML’s meta-types (e.g. kind, role, phase, mixin) should be considered not as restricted to substantial types but instead should be applied to model endurant types in general, including relator types, quality types, and mode types. We also contribute with a formal characterization of this fragment of the theory, which is then used to advance a new metamodel for OntoUML (termed OntoUML 2). To demonstrate that the benefits of this approach are extended beyond OntoUML, the proposed formal theory is then employed to support the definition of UFO-based lightweight Semantic Web ontologies with ontological constraint checking in OWL. Additionally, we report on empirical evidence from the literature, mainly from cognitive psychology but also from linguistics, supporting some of the key claims made by this theory. The purpose of this article is to start a dialogue between the so-called autopoietic enactivism and the semiotic pragmatism of C. S. Peirce, in order to re-examine both action and representation under a Peircean light. The focus lays on autopoietic enactivism because this approach offers a wider theoretical scope to cognition based on the continuity of life and mind, embodiment, dynamic and non-linear interaction between a system and its environment which are compatible ideas with Peirce’s semiotic pragmatism. The term ‘pragmatic’ (...) has been introduced in cognitive science to reinforce the idea that cognition is a form of practice and to help action-oriented viewpoints to escape representationalism. In this paper, I shall try to demonstrate that Peirce’s semiotic pragmatism can be a meaningful methodological path to guide a reconciliation between not only anti-Cartesianism and representation but also representation and action. In order to accomplish this purpose, Peirce’s account to action, habit, thought and mind will be addressed through some of the guiding principles of his semiotic—sign and sign action. What follows is the re-examining of the problem of representation—as refuted by autopoietic enactivism—under the light of Peirce’s semiotic pragmatism. (shrink)

Departing from basic concepts in abstract logics, this paper introduces two concepts: conjunctive and disjunctive limits. These notions are used to formalize levels of modal operators.

The paper focuses on extending to the first order case the semantical program for modalities first introduced by Dana Scott and Richard Montague. We focus on the study of neighborhood frames with constant domains and we offer in the first part of the paper a series of new completeness results for salient classical systems of first order modal logic. Among other results we show that it is possible to prove strong completeness results for normal systems without the Barcan Formula (like (...) FOL + K)in terms of neighborhood frames with constant domains. The first order models we present permit the study of many epistemic modalities recently proposed in computer science as well as the development of adequate models for monadic operators of high probability. Models of this type are either difficult of impossible to build in terms of relational Kripkean semantics [40].We conclude by introducing general first order neighborhood frames with constant domains and we offer a general completeness result for the entire family of classical first order modal systems in terms of them, circumventing some well-known problems of propositional and first order neighborhood semantics (mainly the fact that many classical modal logics are incomplete with respect to an unmodified version of either neighborhood or relational frames). We argue that the semantical program that thus arises offers the first complete semantic unification of the family of classical first order modal logics. (shrink)

Sua abordagem da questão da educação é, na verdade, um profundo questionamento da própria função e do propósito da prática educativa, a qual ele diagnosticou como estando, já em sua época, cada vez mais submissa e atrelada aos interesses de uma economia de mercado, mero adestramento e preparação para o mercado (...) de trabalho. This paper is concerned with the particular problems raised by observations of phenomena outside the common course of nature for their validation as knowledge. It examines to what extent the content of the reports and, in particular, their lack of intrinsic plausibility affected the methods used in their authentication and the assessment of testimony at the Royal Society in the first half of the eighteenth century. I show that literary strategies were usually necessary but not sufficient for the validation of (...) these kinds of observations. Next, I discuss why visual representations were especially useful in establishing the singularity of the observations, but I point out that their high costs and other restrictions meant that they were not so widespread. In contrast I show that, for a long period of time, testimony was used in the majority of the reports as the true stamp of authenticity. I note, however, that the Royal Society accepted reports by authors of varied social status, level of education and occupation, and I discuss some of the factors responsible for the complexity of the handling of testimony at the Society. I argue against Shapin that in the case of reports of extraordinary phenomena, the competence of the reporter and witnesses was often more important than their social status. In 1927 at the fifth Solvay Council, that reunited all the aristocracy of theoretical physics, Einstein, regarding with solicitude the new-born “quantum mechanics” of Louis de Broglie, Schrödinger, Heisenberg and Dirac, discerned with his usual sagacity an indelible mark that was destined to become, with time, a subject of passionate discussion among those whose vocation is to adulate this enigmatic and capricious personality.In 1926 Born had given the prophetic stroke to the portrait. Turning to probability as to the official factotum (...) of the reconciliation of the continuous and the discontinuous-here, the associated wave and particle-he transmuted the waves of de Broglie and Schr6dinger into an undulatory calculus o f probabilities, deducing, from a surprising principle, consequences that were even more surprising but always verified through experiment. Parting from the idea that the intensity of the wave is the probability of the detection of the particle at a given point and time, Born replaced the classic principle of addition of partial probabilities with his “principle of the addition of partial amplitudes” that are, as in classical optics, represented by “complex” dimensions, with one real part and one imaginary part. In general, the square of the module of the sum of amplitudes will be the probability. This expression contains, of course, the terms “square” and “rectangular.” The first, if they were alone, would give the former law; as for the second, they express the existence of phenomena of interference that are at the origin of the thousand and one well verified paradoxes of the “new mechanics “-the one thousand and first being the one under consideration here. This paper shows how to transform explosive many-valued systems into paraconsistent logics. We investigate mainly the case of three-valued systems exhibiting how non-explosive three-valued logics can be obtained from them.

This article proposes a reflection on the persistence of Nazi jurisdictional models in contemporary legal theory, briefly comparing the work of authors such as Wolf, Larenz, Schmitt, Dworkin and Alexy. It aims to demonstrate the authoritarian and radically undemocratic character of certain theoretical constructions used in adjudication, particularly in Brazil. For this purpose, three representative judicial decisions from 2016 are analyzed, highlighting typical structural features of Nazi legal theory which remain accepted by current legal theory, such as the disregard for (...) legality, the personification of the community as judge and the appeal to social values which are taken as self-evident. O presente artigo tem como objetivo mostrar quais são os conceitos retóricos presentes em dois ensaios de Hannah Arendt, Filosofia e Política e Verdade e Política, a fim de explicitar a conturbada relação entre verdade filosófica e política, e como essa querela está relacionada ao modo de vida do filósofo. A retórica e a persuasão não eram em si um problema para o pensamento político de Hannah Arendt, porquanto uma vez que a retórica estivesse condicionada à amizade, ela se tornaria (...) um instrumento político e pedagógico importantíssimo para a manutenção da vida política. Por outro lado, o uso da retórica sem esse condicionamento deixava em evidência a fragilidade de tipos diferentes de verdade diante da opinião, entre elas a verdade filosófica, que embora não seja tão frágil quanto a verdade de fato, depende da preservação do espaço público e do livre uso do discurso. Por fim, demonstrar-se-á a solução desse conflito por meio da possibilidade de uma nova Filosofia Política, que tem como fio condutor o pensamento e a linguagem. (shrink)

Covid-19 brought back memories of past pandemics. In society, a pandemic imaginary was installed, framing an imaginary landscape, alongside a rationalized pandemic intellect to which the media contributed a lot. We live immersed in tele technologies, adding present to the past and past to the present. At a time when home confinement became the rule, this was even more highlighted. In this screen technological Era, social practices were even more subject to the five great sociotechnical effects that condition information and (...) the way it articulates memory and the present: ubiquity, instantaneity, acceleration, mobilization and presentism. This article intends to demonstrate the presence of the imaginary of past pandemics in the present (Applying Einstein's Theory of General Relativity), the way in which we appropriate these memories to create solutions and the way in which we mix the present with the solutions that came from the past. Also included are How to Write History and his most famous piece, A True History, a parody of the popular vogue for fabulous traveller's tales. Each piece has a summary introduction, and notes to clarify obscure allusions in the text. The Introduction examines in some detail Lucian's importance as a dominant Atticizer in the period of the (...) Eclesiologia mais do que tratar dos aspectos gerais da Igreja, tal como tradi-ção, doutrinas, compreensões teológicas, é falar do seu aspecto fundante, passageiro e eterno. Sobretudo partiremos de um olhar universal e plural dessa Igreja que é vista por Cristo, como um só rebanho, apesar de sua institucio-nalização e da multiplicidade de Igrejas Locais, e por razões de insistirmos em dividi-la, essa que é descrita e concebida nos textos neotestamentários e conciliares como a Igreja una, santa, católica e apostólica. Assim (...) sendo, poderemos refletir a Eclesiologia por meio da sua heterogeneidade a constatar que na sua diversidade há uma unipluralidade na sua essência e estrutura. (shrink)

O presente artigo tem como objetivo apresentar a pertinência do recurso da narração tanto na representação quanto da própria constituição da ipseidade. Para realizar esse intento, optou-se por uma estratégia comparativa entre uma posição antinarrativista e uma narrativista no que concerne aos poderes da narração em apreender e compor o domínio das identificações. Em um primeiro momento será realizada uma reconstrução das posições de Jean-Paul Sartre acerca da narração tendo por base a ontologia fenomenológica de O ser e o nada (...) bem como as considerações sobre narrativa e identidade encontradas no romance A náusea e no texto de Diários de uma guerra estranha. O momento seguinte explorará os argumentos narrativistas de Alasdair MacIntyre em Depois da Virtude, de Charles Taylor em As fontes do self e, especialmente, de Paul Ricoeur em Tempo e narrativa e O si-mesmo como outro. Finalmente, no momento mais estritamente comparativo, pretende-se mostrar certas dificuldades da posição antinarrativista, bem como a fecundidade da posição narrativista, no que diz respeito ao distinto modo de administração da demanda por sentido no rechaço antinarrativista da identidade e do acolhimento do desafio de permanente elaboração de sentido da posição narrativista. : In today’s political philosophy framework, it is commonplace to associate Adam Smith with akind of theory that ignores human dispositions and considers only the self-interested perspective ofindividuals. Although this view has been widely supported in different fields – viz Philosophy andEconomy, we consider this a biased interpretation. Using the Cambridge School orientation, we explainthe importance of historical background in reading Smith’s work to argue that Smith’s writings should beinterpreted within the Scottish Enlightenment context. From this contextual approach, it is (...) possible tosustain an integrated reading of Smith’s books The Theory of Moral Sentiments (TMS) and An Inquiryinto the Nature and Cause of the Wealth of Nations (WN). This reading leads to a more faithfulinterpretation of Smith’s idea that the agent in society is morally engaged in socio-economic relations.Once this hypothesis is confirmed, we will defend a systematic analysis of Smith’s philosophy arguingthat Smith’s philosophy is a holistic system, in what we call a tripartite theory.
